These Terms and Conditions apply equally to the platforms bewerbungsapp.ch and jobhani.ch, which are operated by the same operator.
JobHani is a web-based and mobile application for creating application documents using artificial intelligence. The platform offers:
As an alternative to the subscription, credits can be purchased. 1 credit = 1 download. Credits do not expire and are non-refundable.
All prices are in Swiss Francs (CHF) and include VAT (8.1%). Current prices are available on the pricing page.
The contract is concluded upon registration on the platform. By registering, you accept these Terms and Conditions and our Privacy Policy.
The use of JobHani requires a minimum age of 16 years. Persons under 16 may only use the platform with the consent of a legal guardian. By registering, you confirm that you are at least 16 years old or have the consent of a legal guardian.
You agree to:
The following actions are prohibited:
JobHani is a digital tool to assist with creating and organizing application documents. The platform does not replace professional career counseling, legal advice, or HR consulting. All content, suggestions, and analyses provided by the platform serve exclusively as non-binding assistance and do not establish a consulting relationship between the operator and the user.
JobHani uses artificial intelligence from third-party providers (namely OpenAI GPT-4o/GPT-4o-mini, Anthropic Claude Haiku, Mistral AI) for generating and analyzing application documents. The use of these AI services involves inherent limitations:
The user is obligated to carefully review all content generated or suggested by the platform for accuracy, completeness, and appropriateness before use, sharing, or sending, and to adjust as needed. The responsibility for the final version of all application documents lies solely with the user.
The operator provides no guarantee or assurance regarding the success of applications, invitations to interviews, or the establishment of an employment relationship. Using the platform does not automatically increase the chances of employment.
Payments are processed through Stripe. Accepted payment methods:
The Stripe Terms of Service also apply. Credit card data is processed directly by Stripe and does not reach our server.
Subscriptions are automatically renewed monthly unless cancelled before the end of the current billing period. Unused quotas (AI generations, downloads) are not carried over to the next month.
As these are digital services that are made available immediately upon conclusion of the contract or receipt of payment, there is no statutory right of withdrawal under Swiss law (CO Art. 40a ff. do not apply to distance contracts for digital content).
For credits and one-time purchases: Since credits are credited and usable immediately, a refund is excluded.
For subscriptions: You can cancel at any time at the end of the current billing period. No pro-rata refund is provided.
You can cancel your subscription at any time in the Settings. Cancellation takes effect at the end of the current billing period.
After cancellation, your cloud data (documents, jobs) remains available for 30 days. If you resubscribe within this period, your data is immediately available again. After the 30 days expire, cloud data is automatically and irrevocably deleted. Locally stored data (browser) is not affected by the cancellation.
You can delete your account at any time in the settings. This results in:
We reserve the right to suspend or terminate user accounts without notice in case of violation of these Terms. No refund is provided for serious violations (e.g., abuse, automated mass queries).
The user is solely responsible for:
The user may only upload or use data and documents that they are authorized to use. In particular, it is prohibited to upload or process third-party documents (e.g., others' references or CVs) without their express consent. The user indemnifies the operator against all third-party claims arising from a violation of this obligation.
The operator strives for high platform availability but cannot guarantee it. There is no entitlement to uninterrupted, error-free, or always available services. The operator is not liable for temporary or permanent technical disruptions, server failures, maintenance work, transmission errors, limited accessibility, or other technical problems. Planned maintenance will be announced in advance where possible.
For paid services (subscription, credits), the operator warrants that the contractually agreed functions are provided essentially as described. In the event of a significant defect that substantially impairs use and cannot be remedied within a reasonable period, the user is entitled to:
Beyond the warranty mentioned in Section 9.2, the operator provides no warranty — whether express or implied — for:
The operator's liability is — to the extent permitted by law — limited as follows:
The operator is specifically not liable for:
To the extent the operator is liable, total liability — regardless of legal basis — is limited to the amount the user actually paid to the operator in the 12 months preceding the damage-causing event. For users of the free offering (Free Tier), liability is limited to CHF 0.00.
The above limitations and exclusions of liability apply to the extent permitted by law. Mandatory statutory liability provisions — in particular liability for intent, guaranteed properties, and personal injury — remain unaffected in all cases and are not restricted by these Terms.
You are responsible for backing up your data. We recommend regular downloads of your documents as PDF or DOCX. Locally stored browser data may be lost due to browser updates, cache clearing, or device changes.
You retain all rights to the content you upload (CVs, documents, photos). Generated cover letters and CVs also belong to you. You only grant us the right to process your content for the purpose of providing our services.
The software, design, templates, and all content of the platform are protected by copyright (Swiss URG) and may not be copied, decompiled, or distributed without written permission.
The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.
We reserve the right to change these Terms at any time. Changes will be communicated by email to the registered email address. If you do not object within 14 days of delivery, the new Terms are considered accepted. In case of objection, you have the right to extraordinary termination.
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict of law provisions.
The place of jurisdiction is Kriens, Canton of Lucerne, Switzerland, to the extent permitted by law. For consumers domiciled in Switzerland, the mandatory jurisdiction at the consumer's domicile also applies (Art. 32 CPC).
If individual provisions of these Terms are invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.
